And we're back with Season 2 of the COLE Litigators PowerHour, which this season is our COLE Institute, a trial-advocacy course that follows the structure of Season 1 but provides hands-on practice for our core group of attendees. Even if you are not part of this group, you can still listen in for new insights on each of the topics from this year's co-host, seasoned litigators Jason Gammons, Nate Royer, PrmeCOLE himself (me), and our most excellent Producer Adam McConnaughy. This first session, firing up the crowd with some litigation talk and then a dive into the importance of analyzing the case early in the process.

No, when you stand up to give your closing argument in your hotly contested trial, you better be THE GREATEST SHOW ON EARTH®. Not the clown, not the strongman, not one of the trained animals, not the trapeze act … though those all sound like awesome jobs. But the ringmaster … and maybe a bit of a juggler. NOTE!!! There are clips from a closing argument in here and the volume is very low -- best to turn up volume high for those few minutes now and again.

Direct examination, really direct “conversation,” is not about crafting a questions-and-answers script that counsel and the witness practice over and over in anticipation of a perfect presentation at trial. Unsurprisingly, that perfect plan never materializes. Direct “conversation” is about your role in guiding the witness through their testimony, a journey that may not be, and need not be, a straight line. Direct “conversation” emphasizes your role in the presentation, embrace it.
